CLIENT COACHING AGREEMENT

SECTION 1 – PARTIES TO THIS AGREEMENT

Client Coaching Agreement

This Client Coaching Agreement ("Agreement") sets out the terms and conditions governing the professional coaching relationship between:

Molly Ruby-Coco (trading name), operated by Molly Clements, a sole trader established in England ("Coach", "I", "me", "my"),

and

The Client, being the individual purchasing and participating in the coaching services ("Client", "you", "your").

By purchasing, booking or participating in any coaching service, programme, consultation, workshop, retreat, digital product or related offering provided by Molly Ruby-Coco, you confirm that you have read, understood and agree to be legally bound by this Agreement.

This Agreement applies whether coaching services are purchased directly through my website, by invoice, by written agreement, or by any other booking method.

 

SECTION 2 – ABOUT THIS AGREEMENT

This Agreement has been created to establish a clear, respectful and professional coaching relationship that supports both parties.

Its purpose is to:

  • define the scope of the coaching relationship;

  • clarify expectations and responsibilities;

  • explain how coaching services are delivered;

  • protect the wellbeing of both Coach and Client;

  • explain how your personal information is handled;

  • outline payment, cancellation and refund terms;

  • explain circumstances in which coaching may be paused or terminated; and

  • ensure that services are delivered ethically, professionally and in accordance with applicable laws.

Where separate policies are provided (including but not limited to the Privacy Policy, Website Terms of Use, Cookie Policy, Informed Consent Form, Cancellation Policy or Safeguarding Policy), those documents form part of this Agreement where applicable.

 

SECTION 3 – WHO THIS AGREEMENT APPLIES TO

This Agreement applies to all coaching services offered under the Molly Ruby-Coco brand, including but not limited to:

  • One-to-one coaching programmes

  • Three-month coaching programmes

  • Six-month coaching programmes

  • Discovery calls

  • Group coaching

  • Online workshops

  • Masterclasses

  • Retreats

  • In-person coaching sessions

  • Google Meet coaching sessions

  • Human Design coaching

  • Gene Keys coaching

  • Astrology-based coaching

  • Tarot-based coaching

  • Meditation sessions

  • Guided visualisations

  • Nervous system education

  • Subconscious coaching

  • Identity coaching

  • Embodiment practices

  • Journalling exercises

  • Digital workbooks

  • Courses

  • Audio recordings

  • Downloadable resources

  • Future coaching services provided under the Molly Ruby-Coco brand.

If a separate written agreement is created for a specific programme, that agreement will take precedence where there is any inconsistency.

 

SECTION 4 – MY COMMITMENT TO YOU

As your Coach, I am committed to creating a coaching environment that is:

  • supportive

  • respectful

  • non-judgemental

  • confidential (subject to legal exceptions)

  • encouraging

  • ethical

  • professional

  • collaborative.

I will always seek to act in your best interests while remaining within the professional scope of coaching.

I commit to:

  • treating you with dignity and respect;

  • maintaining appropriate professional boundaries;

  • acting honestly and with integrity;

  • communicating clearly;

  • protecting your personal information in accordance with applicable data protection laws;

  • maintaining confidentiality except where disclosure is required by law or where there is a serious concern for safety;

  • recognising the limits of my professional competence;

  • referring you to an appropriately qualified professional where coaching is no longer the most appropriate form of support;

  • continually developing my professional knowledge and coaching skills.

I reserve the right to decline, pause or terminate coaching where I reasonably believe that continuing coaching would be unsafe, unethical, outside my scope of practice or otherwise inappropriate.

 

SECTION 5 – YOUR COMMITMENT AS THE CLIENT

Coaching is a collaborative process.

By entering into this Agreement you acknowledge that:

  • you are choosing to participate voluntarily;

  • you are responsible for your own decisions, behaviours and actions;

  • you remain responsible for seeking appropriate professional advice where required;

  • you understand that coaching requires your active participation;

  • you agree to communicate honestly throughout the coaching relationship;

  • you agree to treat the Coach respectfully;

  • you will not attend sessions while under the influence of illegal drugs or alcohol in a manner that impairs your participation;

  • you will provide accurate information relevant to the coaching relationship;

  • you understand that sustainable personal change requires ongoing effort outside coaching sessions.

You acknowledge that the Coach cannot make decisions on your behalf.

Any action you choose to take following coaching is your own decision and remains your own responsibility.

 

SECTION 6 – ELIGIBILITY

By entering this Agreement you confirm that:

  • you are at least 18 years of age;

  • you have legal capacity to enter into a binding agreement;

  • the information you provide is accurate;

  • you are participating on your own behalf and not on behalf of another person unless expressly agreed in writing.

Coaching services are currently provided only to adults.

No services are intended for individuals under the age of eighteen.

 

SECTION 7 – THE COACHING RELATIONSHIP

Coaching is a forward-focused, collaborative process intended to support personal development, increased self-awareness, learning, reflection and goal achievement.

The coaching relationship is one of partnership rather than advice-giving.

The Coach does not direct the Client's life, make decisions on the Client's behalf or assume responsibility for the Client's personal, professional, financial or health-related outcomes.

The Client remains solely responsible for:

  • personal decisions;

  • relationships;

  • finances;

  • employment;

  • business decisions;

  • legal matters;

  • health decisions;

  • emotional wellbeing;

  • implementation of any actions discussed during coaching.

The Coach's role is to facilitate exploration, reflection, learning and accountability.

 

SECTION 8 – PROFESSIONAL ETHOS

Molly Ruby-Coco provides coaching grounded in respect for personal autonomy, self-responsibility and informed choice.

Coaching may draw upon a variety of educational, reflective and personal development approaches, including, where appropriate:

  • subconscious belief exploration;

  • identity development;

  • nervous system education;

  • mindset coaching;

  • journalling;

  • meditation;

  • guided visualisation;

  • embodiment practices;

  • Human Design;

  • Gene Keys;

  • astrology;

  • tarot;

  • intuitive questioning;

  • values clarification; and

  • other coaching methodologies.

These approaches are used solely as tools to encourage reflection, personal insight and self-awareness.

They are not presented as scientific, medical, psychological, psychiatric, legal or financial assessments, nor should they be relied upon as substitutes for advice from appropriately qualified professionals.

The Client is always free to accept, reject or question any invitation, exercise or perspective offered during coaching.

CLIENT COACHING AGREEMENT

SECTION 9 – SCOPE OF COACHING SERVICES

9.1 Nature of Coaching

The coaching services provided by Molly Ruby-Coco are designed to facilitate personal development, self-awareness, personal growth, goal achievement and conscious decision-making.

Coaching is a collaborative process intended to encourage clients to deepen their understanding of themselves, explore their beliefs, identify opportunities for growth and develop practical strategies aligned with their own values and aspirations.

The coaching relationship is educational, developmental and future-focused. While coaching conversations may involve reflection on past experiences where relevant, the purpose is to support the Client in creating greater awareness and making informed choices moving forward.

The Coach does not direct the Client's life or make decisions on the Client's behalf. The Client remains solely responsible for all personal decisions, actions and outcomes.

 

9.2 Coaching Modalities

To support each Client's individual goals, coaching may incorporate a range of reflective and educational approaches, including but not limited to:

  • subconscious belief exploration;

  • mindset coaching;

  • identity coaching;

  • nervous system education;

  • embodiment practices;

  • guided visualisation;

  • meditation;

  • journalling;

  • values clarification;

  • accountability coaching;

  • Human Design;

  • Gene Keys;

  • astrology;

  • tarot;

  • intuitive questioning;

  • mindfulness practices;

  • personal development frameworks;

  • goal setting;

  • habit development; and

  • other coaching tools that the Coach reasonably considers appropriate.

These approaches are offered as tools to encourage reflection, personal insight and self-awareness.

The Client understands that these modalities should not be interpreted as scientific, medical, psychological or diagnostic methods.

The Client remains free to accept, decline or discontinue participation in any coaching exercise at any time.

 

SECTION 10 – WHAT COACHING IS NOT

The Client understands and agrees that coaching is not:

  • psychotherapy;

  • psychology;

  • counselling;

  • psychiatry;

  • medical treatment;

  • healthcare;

  • occupational therapy;

  • social work;

  • crisis intervention;

  • addiction treatment;

  • trauma therapy;

  • cognitive behavioural therapy;

  • family therapy;

  • couples therapy;

  • legal advice;

  • financial advice;

  • investment advice;

  • tax advice;

  • nutritional therapy;

  • physiotherapy;

  • massage therapy;

  • regulated healthcare; or

  • any other licensed or regulated professional service.

Nothing discussed during coaching should be interpreted as replacing advice from an appropriately qualified professional.

Where specialist advice is required, the Client agrees to consult the relevant qualified professional.

 

SECTION 11 – NO MEDICAL OR MENTAL HEALTH SERVICES

The Coach is not acting as:

  • a medical practitioner;

  • psychiatrist;

  • psychologist;

  • psychotherapist;

  • counsellor;

  • mental health professional;

  • healthcare provider;

  • solicitor;

  • accountant;

  • financial adviser; or

  • any other licensed professional.

The Coach does not diagnose, treat, prevent or cure:

  • physical illness;

  • mental illness;

  • neurological conditions;

  • personality disorders;

  • trauma;

  • addiction;

  • anxiety disorders;

  • depressive disorders;

  • eating disorders;

  • psychosis;

  • suicidal ideation; or

  • any medical or psychological condition.

If the Client has concerns regarding their physical or mental health, they should seek advice from an appropriately qualified healthcare professional.

 

SECTION 12 – SPIRITUAL AND REFLECTIVE PRACTICES

As part of the coaching process, the Coach may invite Clients to engage with various reflective or spiritually informed frameworks.

These may include:

  • Human Design;

  • Gene Keys;

  • astrology;

  • tarot;

  • meditation;

  • visualisation;

  • intuitive exercises;

  • symbolism; and

  • other personal development frameworks.

The Client understands and agrees that these approaches are offered solely as reflective tools intended to support self-exploration, curiosity and personal insight.

The Coach does not represent these modalities as scientifically proven, medically validated or capable of predicting future events with certainty.

Any interpretations offered are intended to stimulate reflection and should not be relied upon as statements of objective fact or as a substitute for professional advice.

The Client is encouraged to exercise independent judgement when considering any insights arising from these practices.

 

SECTION 13 – NO GUARANTEES

The Coach is committed to providing coaching services with reasonable care, professionalism and integrity.

However, the Client understands and accepts that:

  • every individual is different;

  • outcomes vary significantly between clients;

  • meaningful change depends upon many factors beyond the Coach's control;

  • coaching requires the Client's active participation;

  • results cannot be guaranteed.

The Coach makes no representation or warranty that the Client will:

  • achieve any specific personal outcome;

  • achieve financial success;

  • increase income;

  • grow a business;

  • improve relationships;

  • improve health;

  • experience spiritual awakening;

  • experience emotional healing;

  • manifest particular opportunities;

  • obtain employment;

  • receive promotions;

  • achieve any other desired outcome.

Testimonials shared by previous clients represent individual experiences only and should not be interpreted as promises or guarantees.

 

SECTION 14 – CLIENT RESPONSIBILITY

The Client acknowledges that they are solely responsible for:

  • decisions;

  • behaviours;

  • actions;

  • implementation;

  • personal wellbeing;

  • relationships;

  • career decisions;

  • business decisions;

  • financial decisions;

  • health decisions;

  • legal decisions;

  • emotional responses.

The Coach cannot and does not assume responsibility for any consequences arising from the Client's choices.

The Client accepts full responsibility for evaluating any ideas, exercises or suggestions discussed during coaching before choosing whether to implement them.

 

SECTION 15 – INFORMED CONSENT

By participating in coaching, the Client confirms that they:

  • understand the purpose and nature of coaching;

  • understand that coaching differs from therapy, counselling and healthcare;

  • understand that participation is entirely voluntary;

  • understand they may decline any coaching exercise;

  • understand they may ask questions at any time;

  • understand they may withdraw from coaching in accordance with this Agreement;

  • understand that no guarantees have been made regarding outcomes;

  • understand that coaching involves personal reflection which may occasionally feel emotionally challenging.

The Client confirms that they enter into the coaching relationship freely and without coercion.

 

SECTION 16 – CLIENT SUITABILITY

The Coach reserves the right to determine whether coaching is appropriate for a prospective or existing Client.

The Coach may decline, postpone, pause or terminate coaching where, in the Coach's reasonable professional judgement:

  • coaching falls outside the Coach's scope of practice;

  • the Client requires medical, psychological or psychiatric support;

  • the Client requires crisis intervention;

  • continuing coaching may pose a significant risk to the Client, the Coach or others;

  • the Client repeatedly behaves abusively, threateningly or in a manner that prevents a safe and respectful coaching relationship;

  • the Client persistently fails to engage with the coaching process after reasonable efforts to address the issue.

Where appropriate, the Coach may encourage the Client to seek support from a suitably qualified professional before coaching resumes.

SECTION 17 – PROGRAMME DELIVERY & CLIENT EXPERIENCE

 

17. Programme Structure

Coaching programmes are designed to provide structured, collaborative support over an agreed period.

At the time of entering into this Agreement, Molly Ruby-Coco offers coaching programmes including, but not limited to:

  • Three-Month Coaching Programmes;

  • Six-Month Coaching Programmes;

  • Individual coaching sessions (where offered);

  • Group coaching programmes;

  • Workshops;

  • Masterclasses;

  • Retreats;

  • Online educational programmes;

  • Digital resources.

Programme details, including duration, pricing, session frequency and inclusions, will be confirmed before purchase.

The Coach reserves the right to develop, amend or discontinue coaching services at any time. Such changes will not materially affect programmes already purchased unless agreed with the Client.

 

18. Session Delivery

Coaching sessions are ordinarily delivered online using Google Meet.

Sessions will usually last between 60 and 90 minutes, depending on the programme purchased.

Future coaching services may also be delivered:

  • in person;

  • by telephone;

  • via other secure video conferencing platforms; or

  • through alternative communication methods agreed in writing.

Where coaching is delivered in person, additional terms relating to venue, safety and travel may apply.

 

19. Scheduling Sessions

Sessions will be scheduled by mutual agreement.

The Client acknowledges that programme momentum is an important part of the coaching process and agrees to make reasonable efforts to attend scheduled sessions.

The Coach will also make reasonable efforts to provide appointments that are suitable for both parties.

Where practical, sessions should be booked in advance to ensure continuity.

 

20. Session Attendance

The Client agrees to:

  • attend sessions on time;

  • arrive prepared;

  • participate honestly;

  • minimise interruptions where reasonably possible;

  • attend from a private and appropriate environment where confidentiality can be maintained.

If the Client joins a session while driving, operating machinery or otherwise unable to engage safely, the Coach reserves the right to postpone or end the session.

 

21. Late Arrival

If the Client arrives late:

  • the session will still finish at its scheduled end time unless the Coach chooses otherwise;

  • additional time cannot be guaranteed;

  • the full session fee remains payable.

If the Coach is unexpectedly delayed, every reasonable effort will be made to provide the full agreed coaching time or arrange a suitable alternative.

 

22. Missed Sessions

If the Client fails to attend a scheduled session without providing the required notice set out in this Agreement:

  • the session will ordinarily be considered forfeited;

  • no refund will be due;

  • the Coach is under no obligation to provide an alternative appointment.

The Coach may, entirely at her discretion, offer an alternative appointment where circumstances reasonably justify doing so.

 

23. Rescheduling

The Client may request to reschedule a coaching session by providing at least 24 hours' notice.

Rescheduling requests made with less than twenty-four hours' notice cannot be guaranteed and may be treated as a missed session.

The Coach understands that genuine emergencies occur and will consider exceptional circumstances reasonably and compassionately.

Repeated short-notice cancellations may affect the continuation of coaching.

 

24. Coach Cancellation

If the Coach needs to postpone a session because of illness, family emergency, technical difficulties or other unforeseen circumstances, the Client will be offered:

  • a replacement appointment;

  • an extension of the coaching programme where appropriate; or

  • another mutually agreed solution.

The Coach will always seek to minimise disruption.

 

25. Communication Between Sessions

Depending on the coaching programme purchased, support between sessions may include:

  • email;

  • Telegram messaging;

  • voice notes;

  • shared documents;

  • worksheets;

  • reflective exercises.

Between-session support is intended to complement coaching sessions and is not an unlimited messaging service.

Unless otherwise agreed in writing, the Coach will aim to respond within approximately five business days, although response times may vary due to holidays, illness or other commitments.

The Coach is not expected to monitor messages continuously and does not provide twenty-four-hour support.

 

26. Emergency Communications

The Client acknowledges that:

  • coaching communications are not monitored continuously;

  • coaching messaging services must not be used during emergencies;

  • the Coach cannot guarantee immediate responses.

If the Client experiences:

  • a medical emergency;

  • a mental health crisis;

  • thoughts of harming themselves;

  • thoughts of harming another person;

  • or any situation requiring immediate assistance,

the Client agrees to contact:

  • local emergency services;

  • their healthcare provider;

  • an appropriate crisis support service; or

  • another suitable emergency contact within their own country.

The Coach does not provide crisis intervention services.

 

27. Programme Completion

Coaching programmes conclude on the agreed programme end date.

Unused sessions will ordinarily expire unless otherwise agreed in writing.

The Coach may, at her discretion, extend programme access where exceptional circumstances justify doing so.

 

28. Programme Pause

Occasionally, it may be appropriate to temporarily pause coaching.

Examples include:

  • significant illness;

  • bereavement;

  • family emergency;

  • serious unforeseen circumstances.

Programme pauses are granted solely at the Coach's discretion and any agreed pause period will be confirmed in writing.

 

29. Payment

Fees will be communicated before coaching commences and a link shall be provided to the Client via email to a secure payment portal.

Unless otherwise agreed:

  • payment is required in full before coaching begins;

  • payment must clear before the first session is scheduled;

  • all prices are displayed in Pounds Sterling (£) unless another currency is expressly agreed;

  • international payment providers may apply exchange rate fluctuations or transaction fees, which are the responsibility of the Client.

The Coach reserves the right to refuse or postpone coaching until payment has been received.

 

30. Taxes

The Client is responsible for any taxes, duties, bank charges, currency conversion fees or similar charges applicable within their own jurisdiction, unless local law requires otherwise.

Any taxes required by UK law will be handled in accordance with applicable legislation.

 

31. Refund Policy

The Coach wants every Client to make an informed decision before purchasing.

Accordingly:

  • Clients are encouraged to ask questions before enrolling.

  • Refund requests made before the coaching programme has started will be considered in accordance with the Coach's published Refund Policy and any applicable consumer protection laws.

  • Once coaching has commenced, refunds will generally not be available for unused sessions or where a Client decides not to continue, except where required by applicable law or where otherwise stated in writing.

Nothing in this Agreement limits or excludes any mandatory rights a Client has under applicable consumer protection legislation, including the laws of England and Wales and any other mandatory consumer laws that apply to the Client's purchase.

 

32. Cooling-Off Rights

Where the Client purchases coaching online as a consumer, statutory cancellation rights may apply depending on the nature of the services and the laws governing the transaction.

If coaching is due to begin during any applicable statutory cancellation period, the Client may be asked to provide express consent for the services to begin immediately and acknowledge that this may affect or reduce certain cancellation rights, where permitted by law.

Nothing in this Agreement is intended to remove or restrict any statutory consumer rights that cannot legally be excluded.

 

33. Future In-Person Coaching

If coaching is provided in person in the future:

  • both parties agree to behave respectfully and professionally;

  • either party may end the session if they reasonably believe their safety is at risk;

  • venue-specific health and safety requirements must be followed;

  • additional travel or venue costs will be agreed in advance where applicable.

In person coaching may be subject to additional terms and conditions, these shall be provided prior to the session.

SECTION 34 – CONFIDENTIALITY, PRIVACY, DATA PROTECTION & INTELLECTUAL PROPERTY

 

34. Confidentiality

A foundation of the coaching relationship is mutual trust and respect.

Subject to the exceptions set out within this Agreement, all information shared by the Client during coaching sessions will be treated as confidential.

This includes, but is not limited to:

  • coaching conversations;

  • written correspondence;

  • completed questionnaires;

  • intake forms;

  • personal reflections;

  • goals;

  • coaching notes;

  • voice notes;

  • journal entries;

  • worksheets submitted by the Client; and

  • any other personal information disclosed during the coaching relationship.

The Coach will not intentionally disclose confidential information to any third party without the Client's consent except where disclosure is required or permitted by law or where this Agreement expressly provides otherwise.

 

35. Limits of Confidentiality

The Client understands that confidentiality is not absolute.

The Coach may disclose information where the Coach reasonably believes disclosure is necessary:

  • to comply with a legal obligation;

  • to comply with a lawful request from a court, regulator or public authority;

  • where there is a genuine concern that the Client presents a serious and imminent risk of harm to themselves;

  • where there is a genuine concern that another identifiable person may be at serious risk of harm;

  • where safeguarding obligations reasonably require disclosure;

  • where disclosure is otherwise required or authorised by applicable law.

Where appropriate and reasonably practicable, the Coach will endeavour to discuss the need for disclosure with the Client before making such disclosure.

 

36. Privacy and Data Protection

The Coach is committed to protecting the privacy and personal information of every Client.

Personal information will be processed in accordance with:

  • the UK General Data Protection Regulation (UK GDPR);

  • the Data Protection Act 2018;

  • where applicable, the EU General Data Protection Regulation (EU GDPR); and

  • other mandatory privacy legislation that applies to the provision of coaching services.

A separate Privacy Policy explains in greater detail how personal information is collected, used, stored and protected.

Where local privacy laws provide Clients with additional rights, those rights will be respected where legally applicable.

 

37. Information Collected

The Coach may collect and process personal information including:

  • name;

  • contact details;

  • email address;

  • emergency contact details (where provided);

  • coaching goals;

  • intake questionnaire responses;

  • completed assessments;

  • Human Design information provided by the Client;

  • Gene Keys information provided by the Client;

  • astrology information voluntarily supplied by the Client;

  • coaching notes;

  • journal entries voluntarily shared;

  • recordings of coaching sessions;

  • voice notes;

  • payment information processed through third-party payment providers;

  • email communications;

  • messaging history through approved communication platforms;

  • website usage information;

  • technical information relating to online coaching sessions.

Only information reasonably necessary for providing coaching services will be collected.

 

38. Purpose of Processing

Personal information may be processed for purposes including:

  • providing coaching services;

  • communicating with Clients;

  • scheduling appointments;

  • delivering educational resources;

  • maintaining coaching records;

  • improving coaching services;

  • complying with legal obligations;

  • responding to complaints;

  • processing payments;

  • protecting the safety of Clients and the Coach;

  • managing the coaching relationship.

Personal information will not be sold to third parties.

 

39. Storage of Information

Client records may be stored electronically using reputable third-party service providers.

Reasonable technical and organisational measures will be taken to safeguard personal information from unauthorised access, accidental loss, misuse or unlawful disclosure.

No online system can be guaranteed to be completely secure.

By participating in online coaching, the Client acknowledges the inherent risks associated with electronic communications and internet-based services.

 

40. International Clients

The Coach is established in England and provides coaching services to Clients throughout the world where legally permitted.

The Client understands that their personal information may be processed within the United Kingdom or, where appropriate, by carefully selected third-party service providers located in other jurisdictions.

Where international transfers of personal information occur, reasonable steps will be taken to ensure appropriate safeguards are in place where required by applicable law.

The Client remains responsible for ensuring that participation in coaching complies with any laws applicable in their own country.

 

41. AI-Assisted Note Taking

To improve the quality, consistency and accuracy of coaching records, the Coach may use artificial intelligence ("AI") tools to assist with administrative tasks, including:

  • generating summaries of coaching sessions;

  • organising coaching notes;

  • identifying agreed action points;

  • drafting follow-up materials;

  • supporting administrative record-keeping.

AI tools are used solely to assist the Coach and do not replace the Coach's professional judgement.

The Coach remains responsible for reviewing, correcting and approving any AI-generated content before relying upon it.

The Coach will make reasonable efforts to select AI providers that offer appropriate privacy and security safeguards.

Client information will not knowingly be submitted to AI services in a manner intended to train publicly available AI models where the Coach has control over those settings.

The Client acknowledges that AI technologies continue to evolve and agrees that the Coach may update the administrative tools used provided that reasonable regard continues to be given to confidentiality and data protection.

 

42. Recording Coaching Sessions

To support learning and reflection, coaching sessions conducted online may be recorded.

Recordings may be used for purposes including:

  • allowing the Client to revisit sessions;

  • maintaining accurate coaching records;

  • supporting the Coach in delivering continuity throughout the coaching programme.

Recordings will not be shared publicly without the Client's separate written consent.

The Coach will take reasonable steps to store recordings securely.

Clients may request that a particular session is not recorded.

The Coach also reserves the right not to record any session.

 

43. Client Recordings

The Client may make personal notes during coaching sessions.

The Client must not:

  • publish recordings of coaching sessions;

  • distribute recordings;

  • edit recordings in a misleading manner;

  • use recordings for commercial purposes;

  • provide recordings to third parties without the Coach's written permission.

 

44. Data Retention

Client information will only be retained for as long as reasonably necessary to:

  • provide coaching services;

  • comply with legal obligations;

  • resolve disputes;

  • maintain business records;

  • protect the legitimate interests of the Coach.

The applicable retention periods are set out in the Coach's separate Data Retention Policy.

Following expiry of the relevant retention period, personal information will be securely deleted or anonymised where appropriate.

 

45. Client Rights

Subject to applicable law, Clients may have rights including:

  • to request access to their personal information;

  • to request correction of inaccurate information;

  • to request deletion of personal information in certain circumstances;

  • to restrict processing;

  • to object to certain processing activities;

  • to withdraw consent where processing is based upon consent;

  • to receive personal information in a portable format where applicable;

  • to lodge a complaint with an appropriate supervisory authority.

The exercise of these rights may be subject to legal limitations.

 

46. Intellectual Property

All intellectual property rights relating to the Coach's work remain the exclusive property of Molly Ruby-Coco unless expressly stated otherwise in writing.

This includes, but is not limited to:

  • coaching methodologies;

  • coaching frameworks;

  • written materials;

  • worksheets;

  • journals;

  • workbooks;

  • meditations;

  • visualisations;

  • presentation slides;

  • videos;

  • audio recordings created by the Coach;

  • branding;

  • logos;

  • graphics;

  • website content;

  • programme structures;

  • educational resources;

  • downloadable materials;

  • digital products;

  • course content.

Nothing in this Agreement transfers ownership of those rights to the Client.

 

47. Permitted Use

The Client is granted a limited, non-exclusive, non-transferable licence to use materials supplied by the Coach solely for their own personal learning and development.

The Client may:

✔ download materials;

✔ print materials;

✔ annotate materials;

✔ revisit recordings provided by the Coach;

✔ use resources throughout their own personal coaching journey.

The Client must not, without the Coach's prior written permission:

  • copy substantial portions of materials;

  • reproduce programmes;

  • teach the Coach's methods as their own;

  • sell materials;

  • license materials;

  • modify materials for commercial use;

  • upload materials to public websites;

  • share login details to online programmes;

  • create derivative commercial works based upon the Coach's intellectual property.

 

48. Copyright

All coaching resources are protected by copyright and other applicable intellectual property laws.

Unauthorised reproduction or commercial use may result in legal action.

 

49. Testimonials

The Coach greatly appreciates feedback from Clients.

Testimonials may only be published with the Client's separate, informed consent.

Where consent is given, testimonials may be published:

  • on the Coach's website;

  • on social media;

  • within promotional materials;

  • within presentations;

  • in educational resources.

Unless otherwise agreed, testimonials may include the Client's first name or the name by which they wish to be identified.

The Client may request anonymity, and the Coach will respect that request wherever reasonably practicable.

Consent to use a testimonial may be withdrawn for future use, although the Coach may not be able to retract materials already published or distributed before receiving the request.

SECTION 50 – PROFESSIONAL BOUNDARIES, CLIENT SAFETY & LEGAL PROVISIONS

 

50. Professional Boundaries

The coaching relationship is a professional relationship.

The Coach agrees to maintain appropriate professional boundaries at all times.

The Client also agrees to respect those professional boundaries.

Accordingly:

  • Coaching sessions are for coaching purposes only.

  • Coaching does not create a friendship, therapeutic relationship, employment relationship, agency, partnership or joint venture.

  • The Coach is not available on demand outside the agreed communication methods.

  • Personal contact outside the coaching relationship is entirely at the Coach's discretion.

  • The Coach reserves the right to maintain appropriate boundaries in all online and offline interactions.

The Coach may decline communication or requests that fall outside the agreed coaching relationship.

 

51. Respectful Behaviour

The Coach is committed to providing a safe, welcoming and respectful environment.

The Client agrees not to engage in behaviour that is:

  • abusive;

  • threatening;

  • discriminatory;

  • intimidating;

  • sexually inappropriate;

  • harassing;

  • defamatory;

  • dishonest;

  • deliberately disruptive.

This applies during:

  • coaching sessions;

  • emails;

  • messaging platforms;

  • online communities;

  • workshops;

  • retreats;

  • social media interactions;

  • in-person events.

Where such behaviour occurs, the Coach reserves the right to pause or terminate coaching immediately.

 

52. Mental Health

The Coach recognises that emotional topics may naturally arise during coaching.

However, coaching is not intended to diagnose or treat mental health conditions.

The Client confirms that they understand coaching is not an appropriate substitute for:

  • psychotherapy;

  • counselling;

  • psychiatric care;

  • crisis intervention;

  • psychological assessment.

If, during coaching, the Coach reasonably believes that the Client would benefit from mental health support beyond the scope of coaching, the Coach may recommend that the Client seeks assistance from an appropriately qualified healthcare professional.

The Coach may pause or discontinue coaching until such support has been obtained where the Coach reasonably believes this is necessary for the wellbeing of the Client or others.

 

53. Medical Disclaimer

The Coach does not provide:

  • medical advice;

  • diagnosis;

  • treatment;

  • rehabilitation;

  • healthcare services.

Nothing discussed during coaching should be interpreted as medical advice.

The Client remains responsible for consulting appropriately qualified healthcare professionals regarding any medical concerns.

The Client should never delay seeking medical advice because of information discussed during coaching.

 

54. Crisis & Emergency Situations

The Coach does not provide emergency support or crisis intervention services.

The Client agrees that coaching services must never be relied upon during an emergency.

If the Client experiences:

  • thoughts of suicide;

  • thoughts of self-harm;

  • thoughts of harming another person;

  • psychosis;

  • serious mental health deterioration;

  • medical emergency;

  • safeguarding emergency;

  • domestic violence requiring immediate intervention; or

  • any other urgent situation,

the Client agrees to immediately contact:

  • local emergency services;

  • an emergency department or equivalent healthcare provider;

  • their doctor or mental health professional;

  • an appropriate crisis support service within their country; or

  • another suitable emergency contact.

The Coach is not responsible for monitoring communications outside scheduled coaching sessions.

Messages received outside appointments may not be read immediately.

 

55. Safeguarding

The wellbeing of Clients remains a priority.

If the Coach reasonably believes there is a serious and imminent risk of harm to the Client or another identifiable person, the Coach may take appropriate steps, which may include:

  • encouraging the Client to contact emergency services;

  • encouraging the Client to contact an appropriate healthcare professional;

  • recommending suspension of coaching;

  • where legally justified, sharing relevant information with an appropriate authority or emergency contact.

Such disclosure will only occur where the Coach reasonably believes it is necessary and proportionate, taking into account applicable legal and ethical obligations.

 

56. Suspension of Coaching

The Coach may temporarily suspend coaching where, in the Coach's reasonable professional judgement:

  • coaching is no longer appropriate;

  • the Client requires clinical care;

  • safeguarding concerns arise;

  • legal obligations require suspension;

  • the Coach becomes unexpectedly unavailable because of illness or other exceptional circumstances.

Where appropriate, the Coach will discuss available options with the Client.

 

57. Termination of Coaching

Either party may terminate the coaching relationship in accordance with this Agreement.

The Coach may terminate coaching where:

  • continued coaching falls outside the Coach's professional scope;

  • payment obligations have not been met;

  • the Client repeatedly breaches this Agreement;

  • the Client engages in abusive or inappropriate behaviour;

  • safeguarding concerns make continuation inappropriate;

  • the coaching relationship has irretrievably broken down;

  • continuing coaching would be unlawful or unethical.

Where appropriate, the Coach will explain the reasons for termination.

Termination will not affect any rights or obligations that arose before termination.

 

58. Limitation of Liability

The Coach agrees to provide coaching services with reasonable care and professional skill.

However, the Client acknowledges that coaching involves personal choice and independent decision-making.

To the fullest extent permitted by applicable law:

  • the Coach shall not be liable for decisions made independently by the Client;

  • the Coach shall not be liable for indirect or consequential loss arising from the Client's decisions;

  • the Coach shall not be responsible for business, financial, investment or career decisions made by the Client;

  • the Coach shall not be responsible for outcomes arising from the Client's implementation or non-implementation of coaching discussions.

Nothing in this Agreement excludes or limits liability where such exclusion would be unlawful, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • any liability that cannot legally be excluded under applicable law.

 

59. Client Responsibility

The Client accepts full responsibility for:

  • all decisions;

  • all actions;

  • all omissions;

  • all consequences arising from participation in coaching.

The Client acknowledges that meaningful change depends upon their own commitment and participation.

 

60. Third-Party Platforms

Coaching may make use of third-party platforms including, for example:

  • Google Meet;

  • Telegram;

  • Whats App;

  • online payment processors;

  • scheduling software;

  • secure cloud storage providers.

While reasonable care is taken when selecting service providers, the Coach cannot guarantee the uninterrupted availability or security of third-party systems beyond the Coach's control.

The Client agrees that temporary interruptions to third-party services will not constitute a breach of this Agreement where reasonable alternative arrangements are made.

 

61. Force Majeure

Neither party shall be liable for delays or failures to perform obligations caused by circumstances beyond their reasonable control.

Examples include:

  • natural disasters;

  • severe weather;

  • epidemic or pandemic;

  • government restrictions;

  • internet outages;

  • power failures;

  • cyber incidents;

  • war;

  • terrorism;

  • civil unrest;

  • serious illness;

  • bereavement;

  • other unforeseeable events.

Where possible, affected sessions will be rearranged.

 

62. Complaints

The Coach welcomes feedback and aims to resolve concerns fairly and promptly.

Clients who wish to make a complaint should first contact:

The Coach will acknowledge complaints within a reasonable period and seek to resolve them through open communication.

If a complaint cannot be resolved informally, it will be handled in accordance with the Coach's Complaints Procedure.

 

63. Amendments

The Coach may update this Agreement from time to time to reflect:

  • changes in legislation;

  • regulatory developments;

  • business practices;

  • coaching services;

  • technological developments.

Updated versions will apply to future coaching engagements.

Material changes affecting existing coaching programmes will be communicated to affected Clients in advance where reasonably practicable.

 

64. Entire Agreement

This Agreement, together with any documents expressly incorporated into it, constitutes the entire agreement between the Coach and the Client concerning the coaching relationship.

It replaces any previous discussions or understandings relating to the same subject matter.

 

65. Severability

If any provision of this Agreement is found to be invalid, unlawful or unenforceable by a court or other competent authority, the remaining provisions shall continue in full force and effect.

 

66. Waiver

If either party chooses not to enforce any provision of this Agreement on one occasion, this shall not prevent them from enforcing that provision or any other provision in the future.

 

67. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

Where the Client is a consumer who benefits from mandatory consumer protection laws in their country of residence, nothing in this Agreement is intended to deprive the Client of those mandatory legal protections where they apply.

Subject to applicable law, the courts of England and Wales shall have jurisdiction to determine disputes arising under this Agreement.

 

68. Electronic Acceptance

By purchasing, booking or participating in coaching services provided by Molly Ruby-Coco, the Client confirms that they:

  • have read this Agreement in full;

  • have had the opportunity to ask questions before entering into the coaching relationship;

  • understand the contents of this Agreement;

  • freely consent to its terms; and

  • agree to be legally bound by it.

Electronic signatures, digital acceptance through an online booking system, or confirmation by email shall each constitute valid acceptance of this Agreement where permitted by law.
